A blood alcohol concentration (BAC) of 0.10% is high. It exceeds the legal driving limit in every U.S. state, and at this level your crash risk is roughly six times greater than a sober driver’s. You are measurably impaired in reaction time, coordination, and judgment, even if you feel like you’re functioning normally.

How 0.10% Compares to Legal Limits

Every state in the U.S. sets the legal per se BAC limit at 0.08%, with the exception of Utah, which lowered its limit to 0.05% in 2018. A BAC of 0.10% puts you 25% above the standard legal threshold and double Utah’s limit. If you’re pulled over at 0.10%, you meet the legal definition of impaired driving regardless of how you feel or how well you think you’re performing behind the wheel.

It’s worth noting that 0.10% used to be the legal limit in many states before the federal government pushed all 50 states to adopt 0.08% by 2004. So while 0.10% might sound borderline to some people, traffic safety research showed that lowering the limit from 0.10% to 0.08% meaningfully reduced fatal crashes, particularly among repeat offenders. The trend is moving further downward: after Utah adopted its 0.05% limit, traffic deaths decreased and more drivers reported arranging safe rides home, with no measurable negative economic effects.

What 0.10% Feels Like

At 0.10%, most people experience noticeable slurred speech, poor balance, and significantly slowed reaction times. Your ability to track moving objects, like other cars or pedestrians, deteriorates. Fine motor skills become unreliable, making tasks that require precision (steering, braking at the right moment) harder than they feel in the moment.

One of the trickiest aspects of this BAC level is that judgment is also impaired, which means your ability to assess your own impairment is compromised. People at 0.10% commonly believe they’re less drunk than they actually are. This is why someone at this level might genuinely think they’re “fine to drive” while exhibiting clear signs of intoxication to anyone watching.

Crash Risk at 0.10%

A large case-control study by the National Highway Traffic Safety Administration found that drivers at 0.10% BAC face roughly 5.6 to 6.0 times the crash risk of a completely sober driver, after adjusting for age and gender. That’s not a small bump in danger. For context, laboratory studies show that driving impairment begins at levels well below 0.08%, so by the time you reach 0.10%, multiple cognitive and physical systems are significantly degraded.

This elevated risk comes from a combination of factors working against you at the same time: slower reaction to unexpected events, reduced ability to maintain lane position, impaired depth perception, and a tendency to take risks you wouldn’t normally take. These don’t stack up gradually in a way you can feel happening. They accumulate quietly.

How Long 0.10% Takes to Wear Off

Your body eliminates alcohol at a relatively fixed rate, typically between 0.010 and 0.020 per hour. That means starting from a BAC of 0.10%, it takes anywhere from 5 to 10 hours to return to 0.00%. Most people fall somewhere in the middle of that range, so a rough estimate is 6 to 7 hours.

This timeline surprises many people. If you stop drinking at midnight with a BAC of 0.10%, you could still be above the legal limit at 5 or 6 a.m. Coffee, food, cold showers, and fresh air don’t speed up alcohol metabolism. The only thing that lowers your BAC is time. This is why “morning after” DUI arrests are more common than people expect.

What Gets You to 0.10%

How quickly you reach 0.10% depends on your weight, biological sex, how fast you’re drinking, and whether you’ve eaten. Women generally reach higher BAC levels than men of the same weight from the same number of drinks, because women tend to have proportionally less body water and more body fat. Since alcohol doesn’t distribute into fat cells as easily, more of it stays concentrated in the bloodstream.

Heavier people have more water in their bodies to dilute the alcohol, so they typically need more drinks to reach the same BAC. Drinking on an empty stomach also accelerates absorption significantly. As a very rough guideline, a 160-pound man drinking on a mostly empty stomach might reach 0.10% after about five standard drinks in two hours. A 130-pound woman could reach it in three to four drinks over the same period. A “standard drink” is 12 ounces of regular beer, 5 ounces of wine, or 1.5 ounces of liquor. Many cocktails and craft beers contain well more than one standard drink per serving, which is why people often underestimate their intake.

Putting 0.10% in Perspective

On the clinical spectrum of intoxication, 0.10% sits firmly in the “significant impairment” zone. It’s well past the point where driving becomes dangerous, but it’s below levels associated with medical emergencies like alcohol poisoning (which typically begins around 0.25% to 0.30%). That middle ground is exactly what makes it deceptive. You’re impaired enough to be a serious risk to yourself and others, but not so impaired that you’re visibly incapacitated.
