Why Is Miracle Fruit Illegal in the US?

Miracle fruit isn’t illegal. You can buy the berries, grow the plant, and order freeze-dried tablets online in the United States and most other countries. What you can’t do is sell the fruit’s active protein as a food additive or sweetener, because the FDA has never approved it for that use. The distinction matters: the fruit itself is legal to consume, but companies can’t market it as an ingredient in processed foods or as a sugar substitute.

What the FDA Actually Blocked

The story traces back to a Massachusetts company called the Miralin Corporation, which tried to commercialize miracle fruit as a sugar-free sweetener in the early 1970s. The idea was straightforward: replace sugar in foods and drinks with a natural protein that makes sour things taste sweet. Miralin filed a petition in 1974 asking the FDA to classify miracle fruit berries, concentrates, and extracts as “Generally Recognized as Safe,” or GRAS, which would have cleared the path for widespread commercial use.

The FDA rejected the petition. On September 19, 1974, the agency issued a regulatory letter stating there was “insufficient safety data to make a judgment of safe use” and ordered Miralin to “take prompt action to cease interstate shipments of these products.” The agency then evaluated Miralin’s submission as a food additive petition as well and reached the same conclusion: “The data provided are incomplete and inadequate to establish the conditions of safe use of the additive.” Without either classification, miracle fruit couldn’t be sold as a sweetener ingredient. Miralin went out of business.

No company has successfully reopened that petition in the decades since. The protein in miracle fruit, called miraculin, remains classified as an unapproved food additive in the U.S. when used as a sweetener. That classification is the reason you won’t find it as an ingredient on any food label.

Why the Rejection Is Controversial

The FDA’s decision has drawn suspicion for years. Miralin was on the verge of launching products that could have competed directly with artificial sweeteners, and some observers have speculated that the sugar industry or artificial sweetener companies pressured the agency. No definitive proof of industry interference has ever surfaced, but the timing struck many as suspicious: the company had invested years in development only to receive a sudden regulatory letter effectively shutting it down.

What’s clear is that the FDA’s objection was procedural, not based on evidence of harm. The agency said there wasn’t enough data to confirm safety, not that the fruit was dangerous. This is a common regulatory pattern: new food ingredients are treated as guilty until proven innocent. Without a well-funded company willing to spend millions on the required safety studies, the protein has stayed in regulatory limbo.

How Miracle Fruit Works

The protein responsible for the taste-altering effect binds to your sweet taste receptors and just sits there, doing nothing, as long as conditions in your mouth are neutral. When you eat something acidic (lemon juice, vinegar, a sour candy), the drop in pH triggers a shape change in the protein. It flips from blocking the receptor to activating it, sending a strong sweet signal to your brain. Once your saliva returns to neutral pH, the protein switches back off. The effect typically lasts 30 to 60 minutes.

Researchers at the University of Tokyo confirmed this mechanism using human sweet taste receptors in the lab. They found that two specific amino acids in the protein respond to acid by changing how the molecule grips the receptor. At neutral pH, miraculin actually suppresses sweetness slightly. At acidic pH, it becomes a powerful activator of the same receptor that responds to sugar.

Is It Actually Safe?

The safety data that exists is reassuring. The European Food Safety Authority evaluated dried miracle fruit and found no signs of toxicity. In a 90-day study, rats given extremely high doses (2,000 mg per kilogram of body weight daily) showed no adverse effects: no changes in body weight, food intake, behavior, or organ function. An acute toxicity test pushed the dose to 5,000 mg per kilogram with no problems. Genotoxicity studies raised no concerns either.

Human studies have been limited, but none have reported serious side effects. In one study, participants consumed up to 600 mg daily for two weeks with no adverse reactions, not even local irritation of the mouth or tongue. The European panel did flag potential cross-reactivity with peanut allergens, and possible cross-reactivity with latex, peach, and soy allergens. Based on the full data package, EFSA concluded that dried miracle fruit is safe as a food supplement at up to 0.7 grams per day for adults, excluding pregnant and lactating women.

Where You Can Buy It

Despite the FDA’s sweetener ban, miracle fruit is widely available in the U.S. as a consumer product. Freeze-dried tablets and whole berries are sold online and in specialty stores. They aren’t marketed as sweeteners or food additives but rather sold on their own, sidestepping the regulatory restriction. One brand, MiraBurst, is currently being studied in a clinical trial for cancer patients and is described as available over the counter, commonly used multiple times daily before meals.

The European Union accepted an application to authorize dried miracle berry as a novel food in 2018, though the approval process there moves slowly. Japan has been more open to miraculin research and commercial interest for years.

Medical Interest in Miracle Fruit

The most promising application is helping cancer patients eat. Chemotherapy frequently causes a condition called dysgeusia, where food tastes metallic, bitter, or just wrong. There’s no standard treatment for it, and it often leads to poor nutrition and weight loss. A pilot study at Mount Sinai tested miracle fruit in 23 chemotherapy patients who complained of taste changes. Thirty percent reported improved taste, and 35 percent found the fruit helpful overall. When researchers counted patients whose taste at least stopped getting worse, the response rate reached 52 percent. No serious side effects were reported; one patient had mild stomach discomfort and another had slight throat irritation.

These results are preliminary, and the study was small, but researchers described the findings as “encouraging” and confirmed that miracle fruit is safe for chemotherapy patients. Larger trials are now underway to build on this data.

The Bottom Line on Legality

Miracle fruit occupies an odd regulatory space. The fruit itself is perfectly legal to buy, sell, grow, and eat in the United States and most countries. What remains blocked is the commercial use of its active protein as an approved sweetener or food additive. That restriction exists not because anyone proved the fruit is harmful, but because no company has completed the expensive safety dossier the FDA requires to reverse its 1974 decision. In Europe, the approval process is further along but not yet complete. For individual consumers, there’s nothing stopping you from ordering a packet of miracle fruit tablets and trying them with a lemon.
